Terms of Service

These terms govern your use of Voxfloy ("the app", "we", "us"), a speech-to-text utility for iPhone, iPad, Mac, and Apple Watch published by Carlos Henrique. By installing or using Voxfloy, you agree to these terms.

If you also agreed to Apple's standard End User License Agreement (EULA) when installing from the App Store, those terms apply alongside these. Where the two disagree, these terms apply between you and us; Apple's EULA continues to apply between you and Apple.

1. The service

Voxfloy lets you record voice and convert it to text. The default pipeline runs entirely on your device: audio capture, speech recognition, and formatting all happen locally without contacting our servers.

Optional features that require a network and a signed-in account:

You can use the app indefinitely without signing in or enabling either of those features.

2. Your account

Signing in is optional. If you choose to sign in, Voxfloy uses Sign in with Apple. You are responsible for keeping your Apple ID secure. We do not store passwords.

You may sign out from the Account screen in Settings at any time. To delete your authentication record and any synced history rows from our database, contact us at the address at the bottom of this page.

3. Pro (in-app purchase)

Voxfloy Pro is a one-time purchase processed by Apple's StoreKit. We do not handle, see, or store your payment information.

We may suspend or revoke Cloud AI access, history sync, or your account if we have reason to believe you are violating these rules.

5. Cloud AI fair use and rate limits

Cloud AI is rate-limited per user per day. Current limits are visible in-app and may change. Free users get a small daily allowance to try the feature; Pro users get a much larger one. Hitting the limit returns a friendly error and the app falls back to on-device formatting.

We reserve the right to lower limits, suspend Cloud AI for individual accounts, or remove the feature if abuse, cost, or upstream changes make it unsustainable. We will give reasonable notice for material changes affecting Pro users.

6. Content you submit

You retain all rights to the text you transcribe. We do not claim ownership of your content.

By using Cloud AI, you grant us a limited, transient license to transmit the text to our LLM provider for the purpose of returning a formatted version to you. Cloud AI text is not retained after the request completes.

By using cross-device history sync, you grant us a limited license to store your transcribed text in our database for the purpose of synchronizing it to your other signed-in devices. You may delete any entry at any time from any signed-in device.

You are responsible for the legality of the content you transcribe. You agree not to submit content for which you do not have the necessary rights or consents.

7. Privacy

Your data handling is governed by our Privacy Policy. The Privacy Policy describes what we collect, why, and how to opt out.

8. Third-party services

Voxfloy depends on third-party platforms whose terms also apply when you use related features:

We do not control these providers, and their terms apply directly between you and them.

9. Service changes and availability

Voxfloy is offered on an "as available" basis. We may update, modify, or discontinue features at any time. We may also need to take Cloud AI or sync offline temporarily for maintenance, upstream provider issues, or cost containment. We will not knowingly degrade Pro features without offering an equivalent alternative or a path to a refund where required by law.

10. Disclaimer of warranties

Speech recognition is imperfect. We do not warrant that transcriptions are accurate, complete, or fit for any particular professional, medical, legal, or safety-critical use.

11. Limitation of liability

To the fullest extent permitted by law, in no event shall we be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, data, or business, arising out of or related to your use of Voxfloy.

If, despite the above, we are found liable, our total liability is limited to the greater of (a) the amount you paid us for the app in the twelve months preceding the claim, or (b) USD 25.

Nothing in these terms limits liability that cannot be limited by law (including, where applicable, mandatory consumer protection rights in your jurisdiction).

12. Termination

You may stop using Voxfloy at any time by deleting the app and signing out.

We may suspend or terminate your access to optional server-side features (Cloud AI, history sync, Pro entitlement granted server-side) if you violate these terms or if continued provision becomes infeasible. The on-device parts of the app continue to function regardless.

Sections that by their nature should survive termination (rights, disclaimers, liability limits, governing law) survive.

13. Changes to these terms

We may update these terms from time to time. The "Last updated" date above will reflect the most recent change. Material changes affecting paid features will be communicated in-app or via the App Store listing. Continued use after a change constitutes acceptance.

14. Governing law

These terms are governed by the laws of Brazil, without regard to conflict-of-laws principles. Mandatory consumer-protection rights in your country of residence continue to apply where required by local law (for example, the EU Consumer Rights Directive, the UK Consumer Rights Act, the Brazilian Código de Defesa do Consumidor).

Any dispute that cannot be resolved informally is subject to the exclusive jurisdiction of the courts of São Paulo, Brazil, except where local consumer-protection law gives you the right to bring claims in your home jurisdiction.
